PERMANENT LIABILITY RELEASE AND ASSUMPTION OF ALL RISK AND INDEMNITY AGREEMENT

Agreement/Waiver / Release of Liability and Full Assumption of Liability Contract

HUNTING AND/OR OTHER SHOOTING ACTIVITIES INVOLVING FIREARMS ARE INHERENTLY DANGEROUS ACTIVITIES IN WHICH THE USE OF FIREARMS IN CLOSE RANGE OF OTHERS SOMETIMES OCCURS. THIS PROPERTY MAY HAVE OTHER DANGEROUS CONDITIONS, RISKS AND HAZARDS, BOTH OBVIOUS AND LATENT AND BOTH NATURAL AND MAN-MADE, INCLUDING BUT NOT LIMITED TO, HIDDEN OBSTRUCTIONS, THORNS, POISONOUS SNAKES INSECTS, BATS AND SPIDERS, ELEVATED BLINDS, STEEP INCLINES, SHARP AND JAGGED ROCKS LOCATED BOTH ON AND OFF ROADWAYS AND TRAILS THAT CREATE ROUGH, MAZARDOUS AND DANGEROUS DRIVING AND WALKING CONDITIONS, OR OTHER NATURAL OR MAN MADE OBJECTS WHICH MAY BE DANGEROUS TO HUNTERS/GUESTS AND/OR THEIR VEHICLES. HUNTERS/GUESTS MUST LOOK OUT FOR THEIR OWN SAFETY FROM OTHERS BEARING FIREARMS ON THESE PREMISES AS WELL AS PHYSICAL CONDITIONS WHICH MAY EXIST ON THESE PREMISES. HUNTER/PARENT/GUARDIAN/CUSTODIAN HEREBY ACKNOWLEDGES THEY ARE VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH, PROPERTY LOSS OR DAMAGE.

HUNTER’S/GUEST RELEASE/WAIVER OF LIABILITY AND INDEMNITY

As a part of the tawful consideration for being permitted by Bird Camp, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON, and any other property owners on whose land I am allowed ingress and egress (said lends collectively referred to as “Bird Camp”), to participate in hunting, fishing, Swimming, Hiking, Rock Climbing, Repelling and/or other shooting/archery activities and use of the facilities. I hereby agree to the following:

I am aware that hunting with firearms/archery, fishing, swimming, tilking, Rock Climbing, Repelling, Horseback Riding, working operating all terrain vehicles, and all sther vehides/equipment and related ranch activities and activities involving firearms and water (collectively referred to as the “Ranch Activities”) are dangerous and expose me and any minors accompanying me to dangerous conditions. These dangerous conditions include, but are not limited to, poisonous snakes, insects, bats and spiders, elevated blinds and tree stands eroded areas, holes, uncovered wells, steep inclines, sharp and jagged rocks located both on and off roadways and trails that create rough, hazardous and dangerous driving and walking conditions, animals both wild and domestic and maybe diseased and/or possessed with propensities to injure or kill; rushing and still water with perils lurking above and beneath the surface, trees and tree limbe, both dead and alive, that may fall unexpectedly without warning, persons with firearms and other lethal weapons both on or off the Bird Camp the preserice of bare electrical wires to restrain livestock; and the use of vehicles, boats and ATVs both on and off roadways, waterways, ponds and lakes. I hereby acknowledge that I have voluntarily chosen to participate in Ranch Activities with persons I may or may not know. By affixing my (our) signature(s) below, I (we) ionowingly and expressly ASSUME THE RISK of my (our) exposure to the dangerous conditions, risks and hazards expressed above. This assumption of the risk may be used as a defense in a court of law as outlined by the Texas Supreme Court in Farley v, M.M. Cattle Co., 529 5W 20 751, against any allegations either for negligence or gross negligence for failing to warn me (us) of any dangerous natural or man-made conditions that i am (we are) apt to encounter unexpectedly or unexpectedly on the Bird Camp.

I am aware that dangerous wildlife and/or dogs are present on Bird Camp and expose me and any minors accompanying me to dangerous conditions. I assume all risks that may be associated with wildilfe and/or dogs on the rench leicluding death or bodily harm. Including but not limited to biting or being trempled by a dog or wildlife.

Pets

I am aware that death or bodily injury can occur to any pets I bring onto Bird Camp. I am aware that bringing a pet is a serious risk due to the nature of the wildlife and dangerous terrain. I agree to release Bird Camp, LLC DBA BRYOON HOLDINGS LLC, ROBERT AND MEGAN BRYDON of all liability associated with the pets I may bring onto the property.
I agree to assume responsibility for my pet in all circumstances and agree to keep my pet on a leash at all times for the protection of the wildlife and other guests. If I do not keep my pet on a leash I understand. I may be asked to remove the pet from the ranch for the duration of my stay.
I agree my pet kills of injures a wildgame animal will be responsible for the going rate for hunting that animal.

HORSEBACK RIDING

In consideration for allowing me to handle and ride a horse and on behalf of myself, or our personal representatives, beirs, next-of-kin, spouses and assigns, I HEREBY:

Acknowledge that a horse, without warning or any apparent cause, buck, stumble, fall, rear, bite, kick, run, make unpredictable movements, spook, Jump obstacles, step on a person’s feet, push or shove a person, saddies or bridles may loosen or break-all of which may cause the rider to fall or on jolted, resulting in serious injury or death.
ACKNOWLEDGE THAT HORSEBACK RIDING IS AN INHERENTLY DANGEROUS ACTIVITY AND INVOLVES RISKS THAT MAY CAUSE SERIDUS INJURY AND IN SOME CASES DEATH, because of the unpredictable nature and irrational behavior of horses, regardless of their training and past performance.
Voluntarily assume the risk and danger of injury or death inherent in the use of the horse, equipment and gear provided to me by Bird Camp, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON, hereinafter referred to as the Stable.
RELEASE, DISCHARGE AND PROMISE NOT TO SUE Bird Camp, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON, and/or any of its owners, trainers, officers, employees and agents (hereinafter the “Releases”), for any loss, llability, damages, or cost whatsoever arising out of or related to any loss, damage, or Injury (including death) to my person or property.
Release the Releases from any claim that such Releases are or may be negligent in connection with my riding experience or ability including but not limited to training or selecting horses, maintenance, care, fit or adjustment of saddles or bridles, instruction or riding skills or leading and supervising riders.
INDEMNIFY, AND SAVE AND HOLD HARMLESS BIRD CAMP, LLC DBA BRYOON HOLDINGS LLC, ROBERT AND MEGAN BRYDON, its employees, instructors, and agents from and against any loss, Nability, damage or cost they may incur arising out of or in any way connected with either my use of the horse and any equipment of gear provided therewith or any acts or omissions of wranglers or other employees or agents.
The Undersigned expressly agrees that the foregoing release and waiver of liability, assumption of risk, and indemnity agreement is governed by the State of Texas and is intended to be as broad and inclusive as is permitted by Texas Law (RIDE AT YOUR OWN RISK), and that in the event any portion of this Agreement is determined to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effect.
Acknowledge that this document is a contract and agree that if a lawsuit is filed against BERD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON or its owner, trainers, agents, employees for any injury or damage in breach of this contract, the Undersigned will pay all attorney’s fees and costs incurned by BIRD CAMP, LLC DEA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON in defending such an action.
State that I am not now pregnant and that I have no hastory of epileptic seizures, heart condition or any other medical problem that could be affected by horseback riding. If 1 am pregnant or have a history of these medical conditions I agree to not participate in this activity.
IT IS REQUIRED THAT ALL RIDERS WEAR PROTECTIVE HELMET.
If the person who is to enter into this Agreement is less than eighteen (18) years of age, his/her parent or guardian must read this Agreement and sign below on the behalf of the minor.

ROCK CLIMBING AND RAPPELLING

I ACCEPT AND CLEARLY UNDERSTAND THAT THERE ARE INHERENT DANGERS AND OTHER RISKS INVOLVED IN THE ACTIVITY OF CLIMBING, INCLUDING THE RISK OF PERSONAL INJURIES, INCLUDING PARALYSIS AND DEATH.

I understand the hazards of climbing, including by way of example and not limitation, the following: falling because of improperly placed gear, loose or crumbling rock, or climbs that are not property protectable; falling because of improperty tled kriots or rope technique, or improperty buckled harnesses; rockfall or other falling debris; falling onto a ledge or other protrusion. I understand that there are more hazards than are enumerated here, and that there are unknown and unforeseeable hazards.

I understand that climbing gear wears out and that it could be damaged during the week so badly that it is unsafe to use. If any trauma occurs to equipment during the week while I am using it, I will bring it to the attention of the staff member in charge so that he or she has a chance to check the equipment.

I ENGAGE IN THE ACTIVITY OF CLIMBING WITH FULL KNOWLEDGE OF THE INHERENT RISKS OF INJURY, PARALYSIS OR DEATH THAT MAY RESULT. I AGREE TO CLIMB AT MY OWN RISK.

I therefore, for myself and my heirs hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, AND AGREE AND COVENANT TO HOLD HARMLESS, EXONERATE AND INDEMNIFY BIRD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON, or any of its employees liable for any and all such damage, injury, paralysis, or death, I am accepting for myself the full responsibility for any and all such damage, injury, paralysis, or death of any kind which may result, whether such damage, injury, paralysis or death results from the NEGLIGENCE of Bird Camp LLC employees, agents or assigners. I further agree, for myself, or my hets and family not to sue BIRD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND Bird Camp or any of its employees on account of any injuries 1 incur in connection with going on this Bird Camp activity, UNDERSTAND THE RISKS OF CLIMBING AND RAPPELLING AND I HAVE CAREFULLY READ, UNDERSTAND AND VOLUNTARILY ACCEPT THE TERMS OF THIS WAIVER AND RELEASE AGREEMENT.

Runway/Airplane Liability and Indemnity Agreement

I am aware that landing an airplane on a wild game ranch comes with many dangers including but not limited to death or injury by wildlife crossing the runway. Rocks or other debes that may become present on the rumkay. I assume all risk in landing my aircraft on this rugged runway.
I agree to follow all aviation guidelines and regulations and assume all risks of damage or bharm.
I am aware and assume all risks parking my aircraft on Bird Camp and release all liability for damages that may occur from wildlife, employees or other guests T may not know.

ATV, BIKE AND GUIDED TOUR RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

I, being above the age of 18 years of age or the parent of a child under the age of 18 years of age, agree to all terms as follows:

I acknowledge and understand that riding an ATV, Go Kart, Motorcycle, Electric Bille/Mountain Bilies, UTVS AND Guided Tours is a dangerous activity that requires exercise and various degrees of skull and experience for individual riders. I understand that these activities con result in serious injury to the person and damages to property and voluntarily assume any and all risk associated with loss, darnage, injury or death while riding any item that is present on Bird Camp.

I understand that a helmet is required to participate in all off-roading activities and I agree to adhere to this obligation to protect myself and my miner. If my minor is staying at Bird Camp without a legal Guardian, I agree to communicate this obligation to my minor along with any other terms and conditions regarding participating in this Ranch Activity.

I hereby agree to release and forever discharge BIRD CAMP, LLC, DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON, and their agenta, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf from any and all claims, actions, damages, liability, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to my participation or use of the ATV, Go Kart, Motorcycle, Electric Bike/Mountain Bike and UTVs and Guided Tours use of equipment or property supplied by BIRD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON whether or not such claims, actions, damages, llability, cost or expenses are caused by the negligence of rider or driver. By this AGREEMENT, it is my intention to surrender and waive any rights to sue or exercise any legal right to seek damages from BIRD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalt.

This contract is severable: that is, if any part of it is held by a court of law to be unenforceable, the rest of it shall nevertheless be effective.

1, the undersigned, de hereby unconditionally RELEASE, DISCHARGE AND AGREE NOT TO ASSERT A CLAIM AGAINST BIRD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON,, their officers, owners, agents, individuals, directors, family members, partners, employees, guests, attorneys, insurers, host(s) and the property owners on whose land I am allowed to participate in Ranch Activities, (individually referred to as “Release”, and collectively referred to as “Releases”) from all claims, demands, and/or causes of action, that I, my heirs, my family members, distributes, guardians, legal representatives, successors or assigns now have, or may in the future have, for any injury (including without limitation, personal injury or death to my person and/or children) or property damage or property loss resulting from the Ranch Activities, regardless of whether such injuries or damages result from the negligence in whole or in part, or other acts, of myself, Releases, and/or any other person(s) engaging in the Ranch Activities.

I further agree, that in the event any suit or claim is instituted against Releases arising in any way from my negligence, the negligence of my guest, or my children, my agents, my employees or any other persons using the facility with or without my permission; I agree to INDEMNIFY AND HOLD HARMLESS Releases from all liability in connection therewith including, but not limited to, their attorney’s fees and costs involved in connection with the defense of any such action. I further agree to assume any and all liability (including all attorney’s fees and hospital and medical expenses) incurred for any and all claims, which arise during or result from any visit or occupation of the Bird Camp LLC and or participation in Ranch Activities.

I hereby agree to assume any and all liability for and to INDEMNIFY AND HOLD HARMLESS the Releases for any claims which were caused in whole or in part by their own negligence or their gross negligence. I further expressly agree to assume all of the related expenses (including all attorney’s fees and hospital and medical expenses) arising from Releases negligence or gross negligence as it relates to any claim and/or actions that arise during, or result from, my use or occupation of the BIRD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON and/or participation In Ranch Activities.

I hereby assume full responsibility INDEMNIFY AND HOLD HARMLESS Releases from any loss, liability, bodily injury, property damage or loss, or cost, (including all attorney’s fees and hospital and medical expenses) incurred by any Releasee arising out of my, my family members, my minors or my guests participation in Ranch Activities.

I UNDERSTAND THE RELEASE AND INDEMNITY STATED IN THIS AGREEMENT ARE SPECIFICALLY INTENDED TO BE APPLICABLE EVEN IF IT IS ALLEGED OR PROVED THAT ALL OR SOME OF THE DAMAGES INCURRED WERE CAUSED AS A WHOLE OR IN PART BY ANY ACT, OMISSION, NEGLIGENCE, GROSS NEGLIGENCE, OR ANY OTHER CONDUCT WHATSOEVER OF ANY OF THE RELEASEES.

I hereby attest that I will abide by all Federal, State, County and/or BIRD CAMP, LLC DBA BRYDON HOLDINGS LLC, ROBERT AND MEGAN BRYDON laws and/or rules and regulations set out for the hunting, fishing and taking of game. In addition, I understand that I am responsible for all my actions and the Releases are not responsible for my actions, the actions of others or for the theft or loss of any kind. I further agres not to possess, or use, any illegal substance(s), or consume an amount of alcohol that in impairs my physical or mental state while on the Bird Camp LLC.

If any term, provision, covenant, release, assumption or condition of this agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired or invalid.

According to Texas Case Law, the Releasee needs to warn hunters and guests of accidents and incidents occurring on the land that may influence their decision to enter. The following is a list of all accidents and incidents that involved injury or death to a hunter or guest or to the damage or destruction of his or her personal property. The list covers all accidents and Incidents occurring during the past two years.

Insect bites and stings. Roll over ATV accident, resulting in concussions. Roll over ATV accident, resulting in broken ande. Electric bike incidents resulting in head and body injuries.

ACTIVITIES TERMS AND CONDITIONS & RANCH RULES

Welcome!

We’re excited about your stay with us. We are also protective of our land and wildlife. To ensure all will have a great experience, we have provided this important information about your stay with us. The Ranch’s management reserves the right, in its sole discretion, to terminate your hunt and stay at the Ranch without refund and immediately escort you off the Ranch for any violation of any rule.

HUNTING

ALL GUESTS MUST SHOOT THEIR WEAPON OF CHOICE IN FRONT OF ADMINISTRATIVE PERSONNEL UPON ARRIVAL, PRIOR TO GOING AFIELD. All hunters must check into the office and be greeted by the Ranch’s manager or his associates.
All nunters will be required to have and provide proof of a valid Texas state hunting license. Hunters shall carry said license with them at all times while on the Ranch. All hunters must comply with all Federal, State & County hunting laws, rules and regulations.
ALL HUNTS REQUIRE A 50% DEPOSIT OF ANTICIPATED TOTAL HUNT COST refundable if no animal is taken or wounded. CATEGORY & CLASSIFICATION OF ANIMAL BASED UPON THE MANAGEMENT & GUIDES DISCRETION ONLY. WOUND/LOSS POLICY PREVAILS, GUIDES DETERMINATION. Any animal wounded will be charged at the full trophy fee quoted by the Ranch.
Gratuities are generally appreciated and not included in the above pricing. Normal gratuities range from 10-20% of the total hunt. Please do not forget your guide, cook, skönners and all others that help make your hunt and stay a success.
NOT INCLUDED: Texas hunting licenses and permits. Responsibility lies with hunters.
All nunters must check into the office and be greeted by the Ranch’s manager or his associates. All hunters will be required to have and provide proof of a valid Texas state hunting license. Hunters shall carry said license with them at all times while on the Ranch. All hunters must comply with all Federal, State & County hunting laws, rules and regulations.
Safety is our primary concern, please make it yours and abide by the following:
- All guests must have their bolts open on firearms when riding in all vehicles.
- Guests are responsible for making sure of their targets and what is beyond their intended target prior to discharging any firearm.
- No guest, quide or associate is allowed to consume any alcohol the same day of any hunt, unless and until the guest, guide or associate has completed hunting for said day.
No quest is permitted to be on the ranch without an owner, partner or employee, unless approved by owners. If a guest remains alone in a blind while a gulde attends to other matters, the guest shall stay within sight of their assigned blind. Guests are not allowed to walk around the Ranch unless accompanied and supervised by their guide.
A photo of every animal harvested must be taken and all animals harvested must be logged. All wounded animals will be considered dead. No exceptions.
1 attest that 1 am legally permitted to handle, possess and/or use firearms and there is no reason physically, mentally or legally that I shouldn’t possess or use firearms in marksmanship or hunting activities.

Vehicles, ATVs and Bikes

Riding around the ranch in any vehicle, atv or bike is not permitted without a guide. This is not an extreme sports ranch. Vehicles, ATVs and bikes are for guided tours and getting from one location to another. Drive Slow!!!!
Helmets and seatbelts are required at all times.
Prease ride/drive an age appropriate vehicle.
Do not chase animals, chasing animals causes stress to animals and can cause death or serious injury to them.
Damages to the vehicle, atv or bike are to be paid for by the driver of the vehicle. If a minor causes damage the guardian will be responsible for the cost. Drivers accept full resionsibility and liability for death or serious injury of any passengers in the vehicle or persons that may be struck by the vehicle.
Drive slow. Road ways are uneven and loose rocks can cause an accident. Help is a long way away.
Please be aware of getting too close to animais as they can charge you at any time.
Please be aware of clifts and or areas that are blocked off due to dangerous driving conditions, these areas are not permitted to be driven an or near.
Please stay on designated trails.

ROCK CLIMBING & HORSEBACK RIDING

Rock climbing, repelling and horseback riding is only allowed when an instructor is present, and a guided outing is approved.

RANCH RULES

NO DRUGS AND SMOKING

Do not smoke inside any structure, accommodation or building. Illegal drugs are not permitted

DRINKING

Please be considerate of other guests. Excessive drinking and or drunkenness is not permitted.
Excessive profanity or vulganty is nos permitted

PARTY AND EVENT APPROVAL

Ail parties and events must be approved by our Ranch Manager, Matt Perry.
If there are any gatherings that have not gotten approval or are over the guest count they are subject to being shut down by our Ranch Manager (our maximum day guest count is 100).

WILDLIFE ON THE RANCH

We have free ranging ranch exotic animals as well as natural wildlife that should be avoided. There are: Kangaroos, Ostrich, Addies, Anudad, Whitetail, Fallow, Black Buck, Axis, Bison, Water Buffalo, Pere David’s Deer, Scimitar Oryx, hogs, turkeys, venomous snakes, bugs and other dangerous wildlife. DO NOT EVER LEAVE CHILDREN UNATTENDED. Please DO NOT feed any of the exotic animals or wildlife. Also note: no confetti, silly string, waber balloons or other artificial scattered party paraphernalia due to our free ranging wildlife that can get sick from ingesting said Iterms. Real flowers or hers and bubbles are ok. Exploration of the ranch must be with ranch staff and a guided tour.

GATE LOCKS

Only the partners, owners and employees of the ranch are permitted to operate the gate locks and know the combinations. Gates will always remain jocked.

TV’S SATELLITE AND INTERNET

We nave TV’s, satellite and internet service. Your cell service may not work that great.

FIRE PIT

Our fire pit is subject to county restrictions and may not be available for use during your stay

AMENITIES

If you don’t book the entire ranch (just one lodging or two) please note that all amenities are shared spaces.

QUIET TIME

Quiet time from 12am7am unless approved by our Ranch Manager

NO FOOD IN BEDROOMS

No eating or drinking in bedrooms. Please enjoy your misals in the dining room.

SWIMMING POOL

Please use the swimming pool only between 10am and 5pm. All childreis must have an adult watching them in the pool at all times. Food or drinks are not allowed in the pool

PETS

Pets are not allowed.

LAUNDRY

You can do laundry during your stay with a Ranch House or Lodge booking. Please clean the dryer vent after each use.

ELECTRIC BBQ GRILL

Instructions on how to set it up, how to use it, as well as how to properly dean it will be provided at the property.

GARBAGE

Dispose of all garbage into trash birns

DEPOSIT & CANCELLATIONS/CHANGES

Reservations are confirmed upon receipt of your payment unless otherwise specified/agreed upon and/or refundable damage/security deposit). Your reservation payment is non-refundable. You may reschedule your stay up until 7 days prior to the date of your arrival

CHECK IN

Check-in time is any time after JPM and check-out time is by 12PM unless otherwise arranged and noted. Dur Ranch staff will check you in and give you a tour of the facilities

CHECK OUT

Report any damages and/or breakages in a reasonably timely manner. Damages exceeding the security deposit amount must be paid by guests and will be reported to Airont and
Leave all wet towels hanging or on the shower floor (or in laundry hampers)
Leave linens and any used robes ON the beds, we will take care of those
Please make sure all dishes are clean and/or in the dishwasher running.
Please don’t leave any opened food in fridge/freezer.
If you moved furniture (both indoor and outdoor) please put them back in the original location.
Turn off AC/Heat/Lights and be sure to zip up/close up your accommodation.
Leave your keys in your accommodation (or all in the dining hall) and unlocked.

SEPTIC SYSTEM

We have a sensitive septic system so only the tolles paper we provide should be flushed down the toilet. There are signs in each restroom to remind guests to nos flush feminine products or wipes down the toilet, but please note that if there are septic issues from your quests there may be a septic clean out fee:

SURFACES, WALLS AND WALL HANGINGS

Please respect our structures and grounds. Do not puncture or damage surfaces (Indoor & outdoor) in any way. No push-pins, thumbtacks, nalls, duct tape, etc Guests may use painters’ tape (blue), zip ties, rope and wire to hang objects. Our wall hangings are to remain on the walls.

CLEANING, DAMAGES AND RELOCATION FEES

What is on the Ranch stays at the Ranch. Do not borrow or remove anything from the Ranch without approval by Owners. Please do not take indoor furniture, fixtures, bedding, etc, outside. If you move outside furniture, please put it back prior to departure. If any retreat center property is missing or damaged, the person(s) or group will be responsible for paying for the damage out of any security deposit or billed to you. The site manager will determine the cost based oit materials and labor to repair or replace the item(s). We want all to have fun but would also like everyone to leave the place in reasonable condition. We will charge $25/hour for extra cleaning such as: Dirty pans, pots, dishes including dishes with food left out or in refrigerators, carpet spills, etc. Damages will be assessed and invoiced to quests after departure.

HOUSEKEEPING

Housekeeping services are provided. Let us know if you need extra towels. They can be provided and a change of sheets can be given if needed (to be changed on your own). If you need more than one extra set of sheets or set of towels you will be responsible for a $20 deaning fee per set
Guests are also responsible for their own and those in their party, any mess made in the dining hall and agree to clean said mess

SHEETS/BEDDING/PILLOWS/TOWELS, ETC

Please note that if body ous, seif sun tanner or lotions stain or ruin sheets, bedding, pillows, towels, etc that the guest will be responsible for replacement of each item.

CHILDREN UNATTENDED

Children are not to be left unattended anywhere on the ranch.

THERMOSTATS

Do not set any thermostats below 70 degrees. If the thermostat is set below 70 degrees and becomes defective or malfunctions guests will be subject to a replacement fee.

KEYS

Please note if keys for accommodations are lost or stolen there is a $20 replacement fee

LOST & FOUND

Please contact us within 2 weeks after your stay to have us hold any lost items for pick up or mailed (fees paid by quest). After 2 weeks, all items will be donated.

EMERGENCIES

In case of a life threatening emergency: Call 911
The Map Coordinates are: 29,80160 N, -100 28248 W
THEN call Matt Perry (Ranch Manager) on his cell phone at 830-486-3033 and report that you have already called 911, and the location & nature of the emergency.

CODE OF CONDUCT:

I, herein the Guest, understand and agree that I will not:

Harass, harm, threaten, discriminate, libel, defame, or otherwise shame and/or injure “Bird Camp”, its owners, officers, employees, Instructors, contractors, assigns, affiliates, agents, successors, and all other, Guests. If such occurs, one may be asked to leave with no refund.
Purposefully destroy, damage or cause harm to any item, animal, person at event location.
Break any of our rental rules.
Guest understands and agrees that Bird Camp and its affiliates have the right to immediately expel, without refund or transfer of any kind, a Guest who breaks, or is suspicious of breaking, any section on amount of this Code of Conduct

AGREEMENT:

L. herein stated as the guest or guardian of a minor, have read the above Rental Agreements, Terms, Conditions, Acknowledgments & Waivers and fully understand its content. I am legally able to sign and voluntarily agree to and accept all text stated above for myself and those in my party..

Caution: READ BEFORE SIGNING

have carefully read this Waiver and Release of Liability, Assumption of Riak and Indemnity Agreement, and I fully understand its contents. I understand that I have given up substantial rights by signing it, and I am aware of its legal consequences, I am aware that this is a release of ilability and a contract between myself and the Releasees and have signed it freely and voluntarily, without inducement, assurance or guarantee being made to me and intend my signature to be a complete and unconditional legal release of all liability to the greatest extent allowed by law. I further agree that this is a permanent liability release waiver and discharge of me, my heirs, my family members, distributes, guardians, legal representatives, successors or assigns, and indemnity agreement. It shall be considered a continuing release and indemnity agreement, effective for current and all future visits to BIRD CAMP, LLC DBA BRYDON HO HOLDINGS LLC, ROBERT AND MEGAN BRYDON until til this agreement is revoked in writing.

I agree to and have read all terms, conditions and rules of Bird Campand agree to discuss these with my miners that may be accompanying me and/or minors that are not accompanied by a guardian while they are staying at Bird Camp.
